General terms and conditions of the Boosty Blend online store

The general terms and conditions of the online store are drawn up in accordance with the Consumer Protection Act, the recommendations of the Chamber of Commerce and Industry and international codes for e-business. Please read these conditions carefully before using and purchasing in the online store and, if you do not agree with them, do not make the purchase. Registration or purchase in the online store will be understood as agreeing to the terms and conditions, since only these are the basis of the contract concluded between the buyer and the merchant.

 

Definition of terms

The provider is SVETE doo, Laze 24, 1370, Logatec

A user is a person who uses our system, i.e. a buyer in an online store. The online store is an information system designed to present and sell products to the user.

The provider undertakes to always provide the customer with the following information:

1. company identity (company name and registered office, register number)

2. contact addresses that enable fast and efficient communication (e-mail, telephone)

3. essential characteristics of goods or services (including after-sales services and guarantees)

4. product availability (every product or service offered on the website should be available within a reasonable time)

5. conditions of product delivery or service performance (method, place and deadline of delivery)

6. all prices must be clearly and unambiguously determined, it must be clear whether they already include taxes and transport costs, the method of payment and delivery

7. time validity of the offer, during which it is still possible to withdraw from the contract; in addition, also about if and how much it costs the customer to return the product

8. the complaint procedure must be explained, including all information about the contact person or customer service department

 

Purchase process

1. Order accepted

After submitting the order, the buyer receives a notification by e-mail that the order has been accepted. At this step, the buyer has the opportunity to cancel the order within one hour. The customer can always access comprehensive information on the status and content of the order on the provider's website.

2. Order confirmed

If the buyer does not cancel the order, the order goes into further processing, the provider reviews the order, checks the availability of the ordered items and confirms the order or rejects it with a reason. The provider can call the customer on his contact phone number to check the data or ensure the accuracy of the delivery. Upon confirmation of the order, the provider informs the buyer by e-mail about the expected delivery date. The contract for the purchase of the ordered items between the buyer and the provider is irrevocably concluded at this stage.

3. Goods shipped

The provider prepares the goods within the agreed period, ships them and informs the buyer about this by e-mail. In the aforementioned e-mail, the provider also informs the buyer about the return policy, where to contact in the event of a delivery delay, and where to contact in the event of a complaint. The right to withdraw from the purchase, return the goods

The consumer has the right to notify the company in writing (at the contact e-mail address) within 14 days of receiving the goods that he withdraws from the contract, without having to give a reason for his decision. The consumer can submit the notice of withdrawal to the company on the form for withdrawing from the contract (PDF) or with an unambiguous statement from which it is clear that he is withdrawing from the contract (purchase).

The only cost charged to the consumer in connection with withdrawal from the contract is the cost of returning the goods.

The message is considered to be timely if the shipment is sent within the deadline set for withdrawing from the contract.

We do not accept ransom payments.

The goods must be returned to the company no later than 14 days after the notice of withdrawal.

The goods received must be returned undamaged and in the same quantity, unless the goods are destroyed, damaged, lost or their quantity has decreased through no fault of the consumer.

The consumer does not have the right to withdraw from the contract in the case of contracts, the subject of which are goods that are not suitable for return due to their nature. For example, the return of products where the security seal is broken, removed or otherwise damaged or products where it is open or destroyed packaging or film that protects the product from direct contact with the skin or for products for which we cannot say with certainty that they have not been used. The return of these products is not possible to ensure hygiene and health protection.

The consumer is obliged to inform the provider no later than 8 days after receiving the package about any wrongly received products, wrong quantity of products or missing parts of the product. Later complaints about the contents of the packages or products will not necessarily be recognized.

When returning items where a promotional code was used, these funds are considered as a discount and are not returned (the amount paid is returned) to the user's TRR.

We will refund your purchase price as soon as possible, or no later than 14 days after receiving the product at our address.

The company returns the received payments to the consumer with the same means of payment that the consumer used, unless the consumer has explicitly requested the use of another means of payment and the consumer bears no costs as a result.

If the buyer sends the product back within 14 days and asserts the right to a refund, the company will refund the entire purchase price (purchase value of the product, postage and transaction costs).

The consumer can assert his rights from a material defect if he informs the company about the defect within two months from the day the defect was discovered. In the error notification, the consumer must describe the error in more detail and allow the seller to inspect the item. If the buyer asserts the right to refund the purchase price for a product with an actual defect (factory-damaged product), the seller is obliged to return only the purchase value of the product.

The seller is not responsible for physical defects in the goods that appear after two years from the delivery of the product. The defect is material: if the thing does not have the properties necessary for its normal use or for circulation; if the item does not have the properties required for the specific use for which the buyer is buying it, but which the seller was aware of or should have been aware of; if the thing does not have the characteristics and features that have been explicitly or tacitly agreed or prescribed; if the seller has delivered a thing which does not correspond to the sample or model, unless the sample or model has been shown only for notice. If the product has an actual defect and the consumer has correctly informed the seller about the defect, he has the right to request the company to: correct the defect in the goods or return a part of the amount paid in proportion to the defect or replace the defective product with a new flawless product or return the amount paid. Methods of payment The provider offers the following methods of payment: cash to the delivery person, upon collection of the package.

The provider issues an invoice to the customer on a permanent medium, with clearly itemized costs and taxes. Discounts, promotions and other benefits (such as free shipping) are not cumulative.

Issuance of invoices

After the delivery of the ordered products, the BoostyBlend store sends the customer an invoice in PDF format to the customer's e-mail address, unless the customer requests otherwise when placing the order. In the case of personal collection at the branch, the customer receives a printed invoice upon collection. The price and costs related to the purchase are broken down on the invoice. The buyer is obliged to check the correctness of the data when placing the order. We do not consider later objections regarding the correctness of issued invoices.

Delivery time

For in-stock products, the delivery time is 2-30 working days, and these products are usually dispatched the same day and delivered the next working day. For products that are not in stock, the delivery time is up to 100 working days (usually up to 7 days) after receiving the order. In case of a longer delivery time, we will inform you about the delivery time by e-mail or by phone.

Delivery

The provider will deliver the goods or services within the agreed time. The contractual partner for the delivery of parcels is DPD, but the provider reserves the right to choose another delivery service if this will allow him to fulfill the order more efficiently. Delivery and packaging are charged to the customer at the end of the order as a new item on the invoice. For orders above a certain value, packaging and delivery are free.

Validity of the offer

When purchasing, the prices apply at the moment of order confirmation, all prices include VAT. Prices in the online store may change without prior notice. The offer of goods published on the online store is valid until the announcement of cancellation or until stocks last. The BoostyBlend online store concludes contracts in the Slovenian language.

Prices

Prices are valid at the moment of order confirmation and have no future validity. The prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions. Despite our best efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In this case, or in the event that the price of the item changes during the processing of the order, the provider will allow the buyer to withdraw from the purchase, and at the same time the provider will offer the buyer a solution that will be mutually satisfactory. The purchase contract between the provider and the buyer is concluded the moment the provider confirms the order (the buyer receives an email with a notification about the delivery of the package to the post office or the possibility of personal collection). From this moment on, all prices and other conditions are fixed and apply to both the provider and the buyer.

Security

The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data, orders and payments. For this purpose, the online store is protected by a 256-bit SSL certificate issued by an authorized organization.

Communication

The provider may contact the user via means of remote communication only if the first expressly agrees to this. Signing up for e-news via a form on the online store, registering, making a purchase, signing up for sweepstakes or other promotions, or requesting to sign up via other means of communication is considered consent.

Use of personal data

The provider reserves the right to use all collected personal data, for which the user himself has allowed their use and processing, for direct marketing purposes. The provider may use personal data to market any service within the provider's company. Signing up for e-news via a form on the online store, registering, making a purchase, signing up for sweepstakes or other promotions, or requesting to sign up via other means of communication is considered permission to use. In the case of signing up for e-news via the form on the website, a user account with an automatically generated password is created for the user at the same time, except in the case that a user account with this email address already exists. The provider guarantees that all advertising messages will: be clearly and unequivocally marked as advertising messages, the sender will clearly see various campaigns, promotions and other marketing techniques, they will be marked as such, the user's wish not to receive advertising messages, he will conscientiously respect

Protection of personal data

The provider will protect and manage the collected personal data in accordance with the law.

Archiving contracts

The contract concluded by the provider and the user is permanently stored at the company SVETE doo, Laze 24, 1370, Logatec.

Complaints

The provider complies with applicable consumer protection legislation. The provider will make every effort to fulfill its duty, establish an efficient complaint handling system and designate a person with whom, in case of problems, the buyer can contact by phone or e-mail. Submit complaints in writing by email to: info@boostyblend.com. Within five working days, the provider will confirm that it has received the complaint, inform the customer how long it will take to process it and keep him informed about the progress of the procedure. The provider is aware that an essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, the provider makes every effort to resolve any disputes amicably.

Out-of-court settlement of consumer disputes

In accordance with legal norms, we do not recognize any provider of out-of-court resolution of consumer disputes as competent to resolve a consumer dispute that a consumer could initiate in accordance with the Act on out-of-court resolution of consumer disputes. Svete doo, which as a provider of goods and services facilitates online trade in the territory of Slovenia, publishes on its website an electronic link to the platform for the online resolution of consumer disputes (SRPS). The platform is available to consumers on the europa.eu website.

Exclusion of liability

The provider reserves the right to disable the website or disable access to it due to technical or other problems and maintenance, which also means disabling or hindering the use of the online store. The provider is not responsible for reimbursing any damage or costs incurred by the user as a result of termination, non-operation or obstacles in the operation of the website. The provider is not responsible for damage that may occur to the user's hardware, software or other equipment due to the use of the website. The user must ensure adequate equipment protection (antivirus, etc.) before accessing and using the site. With the purchase and the provided contact information, each buyer agrees to the general terms and conditions of business and allows further contact by phone, regular mail or e-mail for the purpose of informing about news, campaigns, etc. In case of disagreement regarding contact, the buyer must inform the company in writing, by mail, to the email address info@boostyblend.com.
